All right. Here's the deal.

I got this email from somebody at the
Music Relief Association. These people were kind enough to tell me that I had one or more midi's posted here that were copyrighted. Well, I was unaware to say the least that I had any copyrighted material here, but... The message went on to say that one of the copyrighted midis (perhaps the only one?) was copyrighted by TMI who has been filing several lawsuits lately against midi site operators. Hence my decision to take my midi files down temporarily, if not permanently.

Now, I'm not going to get into a debate here about whether or not midi files should be allowed to be copyrighted or not. (My personal opinion is that they shouldn't since they are merely a set of instructions, almost like the code for a computer program, that tell the midi sequencer on your sound card exactly what sounds it should generate.) Frankly, I can't see where it would be worth the time and effort for a large coporation such as TMI to sue people running personal, not-for-profit websites with midi files included. They certainly won't get the millions of dollars that they are requesting in the lawsuit. And I seriously doubt that they few thousand dollars that they get from their out of court settlements could pay for their lawyer bills and their court fees. This simply seems to be yet another case of corporate bullying along the lines of Nintendo suing the owner/operator of a web page for including Pokemon in a META tag on his web page. (For those of you who don't know what a meta tag is, suffice it to say that the offending word was not visible to viewers unless one viewed the source code of the web page. I wish I could have found a link the article where I read about this.) There's also an interesting comic about another Nintendo lawsuit over at Penny Arcade. I just cannot comprehend the reasoning behind such frivolous lawsuits. In my opinion we have too many damn lawyers with too much damn time on their hands, and who think they don't have enough damn money in their pockets. I think that what the American justice system really needs is some way of protecting against such dramatic law suits. Perhaps one of these days the American populice will get tired of being pushed around by the big corporations will all the money and power. Unfortunately, those are the kinds of changes that most likely will not happen through the usual channels of law making. Most large corporations have enough law makers in their pocket to protect their interests.

Anyway, this page is mostly a throwback to the days back before mp3's where the only major music format readily available on a computer was midi files, so it is unlikely that I will ever put this material back up for viewing. Also, this is not an issue that care all that much about these days.
