Preface to the Legal Opinion


We present here the legal opinion which was very kindly provided by Robert Wade, Esq., former General Counsel, National Endowment for the Arts. I have here retained the page division on Mr. Wade's original text to make it easier to reference and discuss this text. This opinion was written at our request, in response to a long series of accusations and threats made mostly on the Internet. Mr. Wade has indicated that, in order to encourage and facilitate public discussion of the issues addressed in this opinion, he is relinquishing all copyrights therein, thus placing the work in the public domain. We hope that the publication of this legal opinion will allow students of Tolkien's work to feel free to pursue their studies and share their conclusions with others interested in Tolkien's art and legacy.

The First Amendment to the Constitution of the United States of America reads:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof, or abridging the freedom of speech, or of the press, or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.
