WHAT IMSS IS (Social Security Mexican Institute).

The Social Security Mexican Institute ( IMSS ), is the institution in charge to give to the rightful claimants (workers, beneficiaries y pensioners), the benefits derived from the constitutional rights, such as medical attention, incapacities and pensions. In addition to medical aid to any person who needs it in case of urgency, being rightful claimant or not.

THE RE$OURCE$, where they are obtained from.

The IMSS, obtains their resources to give to their rightful claimants the benefits mentioned before, of the fees that the employers or obligated subjects pay (People either companies that have workers at their charge and perceive a daily salariy or by made work), according to the percentages that the new Law of the IMSS, effective contemplates from July 01, 1997 and in agrrement with the daily integrated salary by the worked days during an established períod, monthly or bimonthly.

IMSS AND CONSTRUCTION, What to do.

If you are going to construct on your property, you must know this.

  1. You are an obligated subject to be registered in accordance with the law of the IMSS.
  2. You must register your workers.
  3. You must register your construction.
  4. You must take the payrolls containing your Name, Address, Employer's IMSS registry (Registro Patronal); The record number of the Construction, Address and type of construction; The Names, RFCs, and the number of affiliation of the workers; worked days, the retention of the quotes of the IMSS and taxes and perceptions agreement with the mexican labor laws.
  5. You must give to your workers, a payment constancy corresponding to every period of work.(Weekly or Biweekly)
  6. You must self determine your fees, according to the registered workers, worked days and integrated daily salary. Using the computer program named SUA.(You can ask for a free copy of this program to the IMSS).
  7. You must pay the fees, at least the 17th. Day of next month of the corresponding fees or to take to the IMSS offices, the diskette with the information generated by the SUA program. This is, if you for some reason are not going to carry out the payment. This will avoid the fines and/or sanctions that are contemplated in the REGULATION OF FINES.

If you are going to contract a company or person to build in your property. You must:

  1. Make all contracts in spanish or a legalized translation of an english contract to the spanish;
  2. Include in contracts the Name, Address, Employer's IMSS registry (Registro Patronal) of the contractor and in addition to ask a copy to him of his IMSS registry;
  3. Specify in the contracts, who will be the person in charge to pay the Social Security fees and all the benefits of the workers, in accordance with the mexican labor laws and regulations;
  4. Notify to the control construction office of the IMSS, contract(s) and the type of work that is being contracted;
  5. Ask to the contractor(s), a copy of the registry of the work or contracted phase and...
  6. Once finished the work, you must ask to your contractor, a fullfillment constancy or directly ask for the constancy to the audit or construction department of the IMSS.

  Note.- If you are constructing without contractor(s), you must pay the fees directly to the IMSS. And if you contract the works, you will pay the fees to the contractor(s) and the contractor(s) to the IMSS. so you must agree that in all the cases: ANYWAY YOU WILL PAY THE FEES..! and perhaps you need to make an analysis of the budget according to the type of work.

AVOID FINES OR PENALTIES

If your intentions are investing in a business or constructing by your own. And do not know about IMSS law, you should contact a consultant or advisor in order to know what to do, this will avoid infringe the regulations and to be candidate for fines or penalties. The fines can be from fifty (50) to three hundred fifty (350) times the minimum salary (30.20 pesos daily salary since January 01, 1998), according to the following:

 

I.- If you are not registered as employer in five days. (You must use the application form AFIL-01);

II.- If you do not register your workers or you register them out of time. (Application form AFIL-02);

III.- If you do not register your construction.(Application form AFIL-15);

IV.- If you do not register them with the real salary;

V.- If you do not determine the fees by yourself or pay them in the terms of the law.(when you have more than .. 4 workers and the date for the payment is at least the 17th day of the next month of the corresponding fees)
