Defining project implementation procedure

Under the Polish law, a substantial distinction has been established for the tendering procedure to be employed in public procurement of an undertaking, depending on its nature, purpose and funding structure. Therefore a choice of a proper act of law should be considered as the first important step in every business case study, in order to ensure suitable and cost-effective project implementation. This is valid especially in the situation, where the local authority together with the potential private partner consider alternative methods of a project procurement.
Due to the recently introduced acts of law:
Act on Public-Private Partnership of the 19th December 2008
Act on Concession for Construction Works or Services
and also existing acts of law:
Public Procurement Act (including chapter on Public Works Concession) , Act on Toll Motorways and National Road Fund, Civil Code based contracts and other admissible under the Polish law procedures, it is vital to match the procedure with the objective and the structure of intended project.

Designing project funding structure

The term "Competitive Dialogue" has been introduced into a Polish public procurement vocabulary and is one of possible procedures to follow with regard to concession or public-private partnership method. The structure of project investment phase funding as well as compensation of the public entity, are the key conditions that are subject to negotiations and prior to the negotiations the basic expectations of the parties have to mutually evaluated. This kind of work requires intermediary and impartial knowledge of the legal and public finance framework and is the essence of our intervention and support.

Project preparation

Both parties of the future transaction usually require feasibility study and sensitivity analysis of the project beforehand. This requires proficiency, the current practice and local knowledge. Project management

Both in preparatory phase and during the implementation on site supervision and support in the process of obtaining all necessary permits leading to building permission are one of the services, that we have already completed in a number of complex investment projects including innovation based projects such as Biodiesel plant for a private investor and synthetic diesel plant fort local association of municipalities in Poland.

Advice, training, introductory support

It is often, that performing preliminary project assessment and evaluation based merely on the information generated by project sponsor is not sufficient and requires impartial and independent advice. We offer such an advisory service. We have also 4 years practice in providing training and support services on general issues related to the public-private partnership and concessions in Poland as well as precisely defined problems linked to the entry into Polish market or participation in the targeted project.
