RENTAL AGREEMENT

 

 

This agreement, entered into on this __________________________________________, by and

between _____________________________________________________________, hereinafter called the landlord (s), and _______________________________________________________,

hereinafter called the tenant (s).

In consideration of the covenants and agreements herein set forth, the parties agree as follows:

1. Landlord(s) hereby rent to tenant(s) those certain premises and real property located at

______________________________________________________________________________for tenancy from month to month, commencing on the __________________________________

at a monthly rental of ____________________________________________________________

which rental tenant(s) expressly agree to pay to the landlord(s) each month in advance commencing the _________________________________ day of each month. This agreement is

self renewing unless written notice of intent is given by either party to terminate or otherwise alter this agreement. A 3-day grace period will be allowed for payment of rent.

2, Tenant(s) agree:

(a) To deposit cleaning and damage bond in the amount of $_____________________________

                              (b) To keep said premises for no other purpose than as a residence.

(c) Not to assign this contract, nor sublet said premises or any part thereof without written consent of the landlord(s).

(d) To leave the premises on the expiration of the tenancy in good repair, reasonable wear and tear excepted, at which time damage bond will be refunded if the tenant(s) leave the premises clean and undamaged. Failure to do so shall result in a full or partial forfeiture of the deposit. Landlord(s) will refund the appropriate deposit or portion thereof after the tenants(s) have vacated complete and returned all keys. Deposits shall not be applied toward any month’s rent.

(e) That the landlord(s) shall be allowed to take immediate possession if the said premises are vacated by the tenants(s) during the term of rental or if the tentant(s) fail to comply with the terms of this agreement.

(f) To save and hold landlord harmless of any claim, cause or liability resulting from the tenancy or occupancy of said premises by the tenant(s) during said rental, it being understood and agreed that the risk to life, health, or property is to be borne by the tenant(s).

(g) It is agreed and understood that the landlord(s) are not responsible for protection against fire, theft or other damage to personal property belonging to the tenant(s).

3. This tenancy may be terminated by either party by giving written notice to the other not less than (3) days before the expiration of the rental month, and said landlord(s) shall have the right to tender and take possession of the premises on expiration of said notice in addition to any other remedies provided by law. Failure to give the required 3 days notice, prior to the expiration of the rental month, shall make the tenant(s) liable for another term as provided in this agreement.

4. Tenant(s) expressly acknowledge receipt in good condition of the personal property as follows: (refrigerator and kitchen range) and agree to not remove any of said property from the rented premises.

                                                            5. Only the tenant, ___________________________________________, shall

occupy the residence. No other person shall live at such residence without the landlord(s) permission.

6. Smoking is prohibited in this unit. This applies to both the tenant(s) and their guests.

7. No pets shall be allowed in this unit without prior written permission from the landlord(s), except as herein noted.

8. Tenant(s) agree to refrain from making loud noises and disturbances. They agree to refrain from playing loud music at all times.

                                                            9. Tenants(s) agree to keep the premises free from garbage and refuse.

Tenants is responsible for one garbage can to be taken to the street for Tuesday a.m. garbage pickup.

10, Tenant(s) agree not to paint or alter the dwelling in any way without first obtaining the landlord(s) written permission.

11. Tenant(s) agree to allow the landlord(s) to inspect the dwelling or show it to prospective tenants(s) at any and all reasonable times, having all due respect for the privacy of the tenant(s).

12. Tenant(s) agree to park only one vehicle on the left side of the driveway or on the street, and never on the lawn or on the right side which is reserved for the upstairs unit. Tenant will not be permitted to park any RV, boat, or other item in the driveway.

 

                                                            13. Tenant(s) agree to be responsible for their own snow removal.

Tenants will be responsible to move their own garbage can to the street. Garbage pickup is early Tuesday morning.

14. Tenant(s) agree to pay for all damage to broken windows which they or their guests have caused.

                                                            15. No electric heating devices will be used in this apartment unit.

 

 

Tenant(s) agree that if they default on the terms set forth in this agreement and if their agreement is placed into the hands of an attorney for enforcement, or if any court filing fees are charged, tenant(s) shall pay all costs of such enforcement, including a reasonable attorney fee.

 

Tenant(s) hereby acknowledge that they have read and understand this agreemnet and agree to comply with all of its terms and conditions. Tenant(s) acknowledge receipt of a copy of this agreement.
