Rholayo's Purchase Contract

The following is taken directly from my contract:

HEALTH GUARANTEE

The purchaser is strongly urged to have the pup examined by a licensed veterinarian as soon as possible. Should the pup be found to have any health problems attributable to Rholayo Kennels, in an examination performed by a licensed veterinarian within 48 hrs of purchase, and the veterinarian's written comments are supplied to Rholayo Kennels within 48 hrs of said examination, the purchaser may return the pup and receive a full refund.

HIP DYSPLASIA

Should this puppy/dog be x-rayed and found to have hip dysplasia before it reaches thirty (30) months of age AND before it is used for breeding, at the purchaser's option, Rholayo Kennels will replace the affected pup with one of the same value, sex, and colour as soon as one is available, or sell the replacement pup and turn over the funds, not exceeding the original purchase price of the affected dog, to the purchaser. Before any replacement or refund is made, the affected dog MUST be sexually altered, or euthanized, or returned to Rholayo Kennels. Any veterinary, transport, etc. fees for either the affected dog, or the replacement pup will be the responsibility of the purchaser. Any x-rays MUST be evaluated by either the Ontario Veterinary College (OVC) or the Orthopedic Foundation for Animals (OFA) before any replacement or refund is made.

EYE DEFECTS

In Retrievers, some hereditary eye problems may not be diagnosed until the dog is well into adulthood. As the severity of different hereditary eye problems vary greatly, should this puppy/dog develop a hereditary eye problem, a replacement or refund will only be made on mutual terms, depending on the age of the dog, severity of the problem, and whether or not the dog can live a normal life and be used for the purpose(s) it was originally sold for. Any eye examination MUST be performed by a board certified American College of Veterinary Opthamologists (ACVO) Diplomate.

ANY OTHER DEFECTS

Should this puppy/dog develop any other proven congenital defect, again, a replacement or refund will only be made on mutual terms depending on age, severity etc.

If ANYTHING is wrong with the dog PLEASE NOTIFY ME IMMEDIATELY AND DIRECTLY. I do not knowingly use affected dogs in my breeding program and alerting me of any problems will prevent other people from having similar difficulties.

PURCHASER'S RESPONSIBILITIES

The purchaser agrees to take due, and reasonable care of the dog for the remainder of its lifetime, ensuring proper shelter, feeding, veterinary attention, and exercise. If for any reason the purchaser decides that he/she is unable to keep the dog, he/she agrees to notify Rholayo Kennels before selling or otherwise disposing of the dog.

NON-BREEDING CONTRACT

This puppy/dog is sold subject to a CKC non-breeding agreement, which I will lift at no charge (current CKC fee excluded) providing the following conditions are met:

1. The dog had been x-rayed and certified clear of hip dysplasia by OVC or received a grade of 'GOOD' or better from OFA.

2. The dog's eyes have been found NORMAL in an examination performed by an ACVO Diplomate.

3. The dog has earned at least one official CKC title.

4. The dog is found suitable in type and temperment for breeding as ascertained by Rholayo Kennels.

Until such time as I lift said agreement, it is understood that the dog is not to bred under ANY circumstances.
