Adolf Neiman respectfully shows
 that he is a native of Germany  that on March 28th 1892
before the clerk of the District Court of Mills County, Texas, he declared an oath that it 
was bona fide his intention to become a citizen of Mills Co(Mills Co has a line drawn 
thru it) the United States and renounce forever all allegiance and fidelity to any foreign
Prince, Potentate, State or Sovereignty whatsoever, and particularly any and all 
allegiance to the Emperor of Germany of whom he was at that time a subject.  That he
has resided in the United States for more than five years and in the State of Texas for
more than five years, immediately preceding this application to become a citizen of the 
United States.
Applicant would further respectfully show that he resided in the United States for more than three years before reaching his majority said three years being those next preceding his 22nd birthday and that including said three years he has continued to reside more than five years in said United States: and that he has never borne any hereditary title, or been of the orders of nobility in his own or any other country.
He therefore prays that, on making proof and taking the oath prescribed by law. He may be admitted a citizen of the United States of America.

This will is recorded in Mills County Courthouse, Goldthwaite, TX, Deed Book 23, page 111.

It is a hand written document with good penmanship and easy to read. All attempts were made to transcribe this copy without errors.

The State of Texas }
County of Mills      } In the name of God amen~~~

--We, George Neiman and Caroline Neiman as husband and wife of the County of Mills, and State of Texas, being each of sound mind and disposing memory, and being mindful of the uncertainly of life and the certainly of death and desiring that our worldly affairs be settled in a satisfactory manner, do make, publish and declare this to be our Last Will and Testament, hereby revoking any and all Wills herefore made by us.

-1- I, George Neimann, husband of Caroline Neimann desire that all my funeral expenses and just debts be paid immediately after my death, after which payments I give and bequeath unto my beloved wife, Caroline Neimann, all my property, real, personal and mixed wherever situated, to have, manage, control, sell and dispose of in any manner she may see fit, make title to such real estate as she may see proper to sell: Make and perfect title to same, release and make title perfect to such real estate as we may have family owned, save and except on certain lot, tract of land, which is now our homestead, where we now reside, and consists of 566 acres out of the Jacob Acker Survey in Mills and Hamilton Counties, Texas, which land and improvements, I desire my wife to have during her natural life, and at her death, to become the property of my daughter, Dora Neiman, together with the Milch cows, work horses, farm machinery, tools and implements, household and kitchen furniture, of which the survivor of us may die possessed and this shall constitute said Dora Neiman’s part and share of our estate, and she shall after taking possession ??? above alluded to, pay over to the other heirs to our estate the sum of four thousand dollars, paying one (1) thousand dollars annually, until said four thousand dollars are fully paid - the interest to dare from the death of the survivor of us, at the rate of 6 % per annum- which said $4,000 is to be paid for the purpose of making the said Dora Neiman’s share more nearly equal with the other heirs, should we own at the death of the survivor of us, something near the same amount of property as is now owned by us.

-2- To my daughter, wife of P. J. Kunkel, to my son, Adolph Neiman, to my daughter, Wilhelmina, wife of August Marvitz, to my daughter, Louisa, wife of Frank Schumann, I give and bequeath a like equal part and share in my said estate, except as above provided.

To my daughter, Mrs. Caroline Foremann, Who is a daughter by my first wife - my said wife died leaving this one child only, and at the death of my said first wife, we owned no property, I will and bequeath one half share in comparison with my other heirs, that is to say, she Mrs. Caroline Foremann, if living, and in the event of her death, her heirs shall have said, one half in our estate, should the shares be two thousand dollars each , then the said Mrs. Caroline Foreman shall have the sum of one thousand dollars. or at the ratio of one to two, in distribution of the estate and in case of my death before the death of my said wife Caroline Neimann, I desire that nothing further be done than the probating of this will and returning unto Court an inventory of the property owned by us at the time of my death, and that no bond be required of her, and I, Caroline Niemann, wife of George Niemann, in the event of my death before that of my beloved husband George Niemann, for him to have, own, manage, control, sell and dispose of , make title to and in every way care for in fee simple, save and except as in provided in the foregoing bequests made by my said husband, George Niemann, and in the said bequests I do fully concur, and ratify the said bequests and gifts as my own act and deed, fully agreeing with my said husband in disposing of our property, and I do here and now adopt the said Will as my own act- the distribution of said property to be made after the death of the survivor of us.

In testimony of all which we hereunto sign our names, at Goldthwaite, Texas on this the 1st day of October, A.D. 1904.

George Niemann/Neiman filed or was involved in various law suits in the District Court of Mills County, Texas from February 1892 through April 25, 1902 according to the index of minutes of the District Court, Book 1. listed below:

Here is a summary of
Case 170 George Neiman Vs Carl Meyer BK 1, Page 342, March 21, 1892 Page 413, Sept. 26, 1892 Page 417, Sept. 27, 1892

I have photocopies of this file.

For Case 170, It appears that on June 20, 1891, George Nieman was ejected from five hundred and fifty-three and a half acres of land that he held a fee simple title to. On Feb. 29, 1892, he filed a suit against Carl Meyer, George Gartman of Mills County, TX for the land, damages and court costs. George Nieman posted a bond for costs on Feb. 29, 1892 with the Mills County District court. The Mills county Sheriff department, G.W. Cunningham delivered Citations that were issued on 1 march 1892 by W.S. Marshall, county clerk of Mills County, Texas, for the pending law suit to Carl Meyer on the 4th day of March, 1892 at a cost of $1.50 serving fee and $1.65 mileage fee for 35 miles. Another citation was delivered on the 4th of March 1892 to George Gartman who must of lived in the town of Goldthwaite, as there was no mileage fee, just the $1.50 serving fee.

On March 11th, 1892, a subpoena was issued for Chas Pfluger to appear in the Mills County District court and testify on behalf of the plaintiff, George Neiman on the ?3rd Monday of March, 1892.

On September 8th, 1892, George Nieman filed an amended petition with the court, adding Chas Pfluger as a defendant, along with Carl Meyer and George Gartman. Citations were issued to Carl Meyer, Chas., Pfluger, and George Gartman on the 8th of September 1892. The sheriff, G. W. Cunningham delivered the citations on the 27th day of October 1892.

On the March term of the court, the counsel of both parties agreeed to continue in the September 1892 term of the court. (Minutes of District Court, Book 1, page 342)

On September 26, 1892 , Minutes of District Court, Book 1, page 413,"This day this cause was called for trial and it being areeed by counsel to continue cause. It is ordered that this cause be continuwd to the next term of this court."

On September 27, 1892, Minutes of District Court, Book 1, page 417, "This day this cause was called for trial and it being areeed by counsel to continue cause. It is ordered that this cause be continued to the next regular term of this court."

They must of settled the cause out of court, as there is no other mention of this action in the records, and on September 26, 1902, the five hundred fifty-three and one half acres was transferred from George Neiman to Adolph Nieman by Warranty Deed. (Deed Book 18, page 271)

Last Will and Testament of Mary Kunkel, dated May 5, 1924

The State Of Texas County of Mills

Know all men by these presents; That I, Mrs. Mary Kunkel, a widow*, being of sound mind and memory, and desirious of disposing of my worldly effects while I have strength so to do, do make and publish this my last will and testament, hereby revoking all others by me heretofore made.

Item 1:
I desire and direct that all of my just debts be paid by my executrix hereinafter named as soon as practicable after my death.

Item 2:
I give, bequeath and demise to my beloved daughter Mary Kunkel, all of the land now owned and possessed by me out of a 553 1/3 acre tract of land out of the James A. Winn survey in Mills County, Texas, conveyed by W.E. Armstrong to P.J. Kunkel by deed dated Jan 22, 1887, recorded in Vol. 7 page 69 of the transcribed deed records of Mills County, Texas, not heretofore conveyed by me to my children, Otto Kunkel, Freda Kunkel, Mrs. Bertha Rust (should read Rost) and Walter Kunkel, by deeds of even date herewith, and her heirs in fee simple forever, to the exclusion of all other persons, with the understanding however, that she shall care for, provide for her sister Edetha Kunkel during the remainer of her natural life, giving her a home, and place of abode on the said land, and treat her kindly, and with such consideration as one sister owes to another, during all of her remaining years, and in addition thereto, I give and bequeath to my said daughter, Mary Kunkel, all of the farm implements, household goods and furniture, and the livestock on my home place at the time of my death.

Item 3:
In the event I shall not prior to my death have conveyed to my beloved daughter, Mrs. Walda Schlee wife of John Schlee Jr. any land or real property in lieu thereof, I give , bequeath and demise to her and her heirs, the sum of Seven thousand dollars, to be invested by my executrix hereinafter named in the purchase for her and her heirs of a tract of land of that value to be selected by the said Mrs. Walda Schlee, and which shall be conveyed to my said daughter, Mrs. Walda Schlee, upon the conditions and considerations of she paying annually thereafter to my daughter, Edetha Kunkel, the sum of Fifty ($50.00) Dollars, the first payment to be at the the time of the execution and delivery of the deed conveying to her the said land. and then annually thereafter so long as my said daughter, Edetha Kunkel shall live, and to be secured by vendor’s lein expressly retained in the said deed. In the event however, that I shall have purchased and conveyed before my death of this value which I comtemplate doing, this bequest shall abate, and be of no futher force or effect, the same having been fully discharged during my lifetime.


Item 4:
All the remainder of my property, owned and possessed by me at the time of my death, not hereinbefore disposed of, I give, bequeath and demise to my beloved children, share and share alike in fee simple forever.

I hereby nominate and appoint Miss Mary Kunkel sole executrix of this my last will and testament without bond, with all of the powers hereinbefore conferred upon my executor, and direct that no action be taken in the matter of my estate, except to admit to proof and probate this my last will and testament, and require the filing of an inventory and appraisement of my estate, and the final report of my executor.

Witmess my hand this the 5th day of May A.D. 1924.
