This Indenture made the Eight day of April in the year of our Lord One Thousand Eight Hundred and Seventy One.  Between JOSEPH LEIBENGUTH, Administrator of all and singular the goods and chattels, rights and credits which were of PHILIP LEIBENGUTH, late of Lehigh Township, Northampton County, Miller, decd, died intestate of the one part and WILLIAM LEIBENGUTH of the County of Lehigh, State of Pennsylvania, Yeoman of the other part.  Whereas the said PHILIP LEIBENGUTH, in his lifetime and at the time of his death was lawfully seized in his demesne as of fee a certain messuage, tenement, Grist Mill and Tract or piece of land situated in the Township of Lehigh aforesaid adjoining Lands of Adam Benninger, Beck, Boyer, _____ Remaly, Craig and Kramer.  Containing thirty-seven acres and one hundred and twelve perches with the appurtenances.  It being the same premises which Peter Leibenguth, Administrator of George Leibenguth, Senior, By his deed dated the twenty-first day of January Anno Domini 1834 and recorded in the Office for Recording of Deeds at Easton on and for the County of Northampton in Deed Book G Vol 6 Page 597 and together with the full free and absolute liberty and privilege for the Philip Leibenguth, his heirs and assigns forever, to uphold the dam and race from which the Mill at present erected of the above described Tract of Land is at present supplied with water on the portion number one of the Real Estate of the Said George Leibenguth, decd. Since his decease wed and conveyed to John Leibenguth all times here after and with absolute and conditional liberty at all times when va casum shall require with his or their workmen, horses, carts and carriages to enter into and open the said portion number one, then of the said John Leibenguth his heirs and assigns with the apurtenances for the purpose of cleaning, repairing, and scouring the said race and rebuilding and repairing and cleaning the said dam for the accommodation of the Dam aforesaid and with the right and liberty also forever, hereafter of taking, using, and leading the water from the dam along and through the race aforesaid in the said portion number one belonging to the said John Leibenguth, his heirs and assigns as the same now runs for the use of the said Mill and Whereas at an Orphan Court deed at Easton in and for the County of Northampton aforesaid on the second day of June Anno Domini 1870 upon the petition of the Heirs of the said Philip Leibenguth, decd praying the Court to award and inquest to make partition of the Real Estate of the said intestate in said petition mentioned to and among his Children and Representatives in such manner and in such proportions as by the Laws of Pennsylvania is directed and appointed if such partition could be made without prejudice to or spoiling the whole otherwise to value and appraise the same the said inquest was awarded by the Court according to the prayer of said petitioners.  Whereas a writ of partition or valuation issued of the said Court to Abraham Gish, George W. Heiney and Daniel Kleckner, commissioners to make partition of the Real Estate to and among the Children and Representatives of the said intestate according to law if such partition could be made without prejudice to or spoiling the whole but if such partition could not be made as aforesaid then to value and appraise the same and that the partition or valuation so made should be distinctly and openly have before the  Judges of the said court at Easton on the nineteenth day of August Anno Domini 1870 at which  day  before the Judges aforesaid the said administrator made return of the commissioner report under their hands and seals and upon their oath say that the Real Estate in said edict mentioned could not be parted and divided to and among the parties therein named without prejudice to or spoiling the whole thereof, and therefore  the inquest aforesaid had valued and appraised the same at the sum of Six Thousand Dollars which return and valuation were on motion confirmed by the Court. And Whereas all the heirs and legal representatives of the said Philip Leibenguth have severally and respectively refused to take the said Messuage, tract or piece of Land at the valuation aforesaid the said court did then and there order the said Joseph Leibenguth Administrator as aforesaid to expose the premises aforesaid to public sale on the 29th day of October then next ensuing, having first given sufficient security according to Law for the faithful performance of the trust committed to him.  In pursuance of which said order the said Joseph Leibenguth administrator as aforesaid after having given due public and timely notice of the time and place of sale did on the day and time therein mentioned expose the premises aforesaid to sale by public vendue or outcry and there not being a sufficient price bidden for the same the sale was adjourned to the twelfth day of November then next after having given due and timely notice of the time and place of sale did on the day and year last aforesaid expose premises to public vendue or outcry and again not a sufficient price being bidden for the same the sale was adjourned and were returned unsold to the said Court on the 25th day of November A. D. 1870  and the report approved by said Court the same day and alias order issued out of the said Court to the said Joseph Leibenguth administrator as aforesaid to expose the premises aforesaid to public sale on the Thirty First day of December then next ensuing.  In pursuance of which said alias order the said Joseph Leibenguth administrator as aforesaid after having again given due public and timely notice of the time and place of sale did on the day and time therein mentioned expose the premises aforesaid to sale by public vendue and wed the same to William Leibenguth for the sum of Two Thousand Six Hundred and Ten Dollars lawful money of the United States, he being the highest bidder and the best price bidden for the same which sale in report thereof made to the Judges of the said Court was in the 27th day of January, 1871 by them confirmed. And it was considered and adjudged by the said Court that the same should be and remain firm and stable forever as by the records and proceedings of the said Court relation being there unto had will more fully and at large appear.  Now this Indenture Witnessth that the said Joseph Leibenguth for and in consideration of the said sum of Two Thousand Six Hundred and Ten Dollars to him in hand paid by the said William Leibenguth at and before the ensealing and delivery hereof the receipt whereof they do hereby acknowledge and thereof acquit and forever discharge the said William Leibenguth, his heirs, executors and administrators by these presents have granted, bargained, sold, released and confirmed and by these presents in pursuance and by virtue of the said order of court do grant, bargain, sell, release, and confirm unto the said  William Leibenguth, and to his heirs and assigns, All that Messuage, Tenement, Grist Mill and  tract or piece of Land situate in the Township of Lehigh, County of Northampton aforesaid. Bounded and described as follows to wit: Beginning at a stone on line of land of Adam Benninger thence South one and three quarter degrees, East twelve perches to a Black Walnut Tree thence by the same. North eighty-eight degrees, East eighteen perches to a Cherry Tree, thence by the same. South fourteen and three quarter degrees, East thirty-five perches and three tenths to a Black Oak tree thence by the same. South thirty six degrees, East seventy six perches and eight tenths to a stone, thence by land of Beck and Boyer.  North eighty one degrees West thirty perches and seven tenths to a stone thence by the same South six and three quarter degrees, West twenty one perches and five tenths to a stone thence by the same, North seventy one degrees, West thirty four perches and four tenths to a stone on the North side of a Black Oak tree thence by land of ____ Remaly.  North twenty seven and three quarter degrees, West seventy five perches to a Maple stump thence by land of Craig and Kramer North twenty one degrees, East twenty perches and nine tenths to a stake in the middle of a creek, thence by the same, North seventeen and three quarter degrees, West twenty eight perches and eight tenths to a stake in said creek, thence by the land of said Adam Benninger, North eighty nine and three quarter degrees, East twenty eight and eight tenths perches to the place of Beginning.  Containing Thirty Seven Acres and one hundred twelve perches strict measure. Together with all and singular other the houses, out-houses, buildings, barn stables, ways, woods, waters, water-courses, rights, liberties, privileges, hereditaments and appurtenances, whatsoever there about belonging on in or in anywise appertaining and the reversions and remainders, unto issues and profits thereof and also all the estate rights title, interest, property, claim and demand whatsoever of the said Philip Leibenguth at and immediately before the time of his decease in law or equity or other wise howsoever of in to or out of the same.  To have and to hold the same Messuage, Grist Mill and tract or piece of Land as aforesaid hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances unto the said William Leibenguth his heirs and assigns to the only proper use and behoof of the said William Leibenguth his heirs and assigns forever and the said Joseph Leibenguth for himself, his heirs, executors, and administration covenant premise grant and agree to and with the said William Leibenguth his heirs and assigns by these presents he the said Joseph Leibenguth has not done committed or willingly or unwillingly suffered to be done or committed any act matter or thing whatsoever, whereby the premises has by granted or any part thereof is are or shall or may be impeached, charged or encumbered in title charge estate or otherwise howsoever.  In Witness Whereof the said Joseph Leibenguth hath hereunto set his hand and seal dated the day and year first above written.

Lerch.  Received on the day of the date of the above written indenture of and form the within named William Leibenguth the sum of Two Thousand Six Hundred and Ten Dollars lawful money of the United States.  It being for the consideration money within mentioned in full.

Be it remembered that on the Eight day of April A.D. 1871 before me A.W. Lerch, one of the Justice of the Peace, in and for said County came the above named Joseph Leibenguth and acknowledged the within written Indenture to be his act and deed and desired that the same might be noted as such according to law.
