“CLIENT” shall mean, for the purpose of This Agreement, any owner of vehicle accepted by GESA ASSISTANCE, together with all non fare paying passengers in the Vehicle, who is entitled to receive assistance pursuant to This Agreement, occurred within Malaysia.

“VEHICLE” shall mean, for the purpose of This Agreement, any Vehicle accepted by The Company.

GESA ASSISTANCE shall not be held responsible for delays or impeachment’s in performing the assistance in case of strike, war, invasion, act of foreign enemies, hostilities (whether war be declared or not), civil car, rebellion, insurrection, terrorism, or military or usurped power, riot and civil commotion, radio activity.

It is understood that all the garages, and any kind of professionals the client may be referred to or any person giving assistance to the Vehicles are for most of them independent contractors responsible for their own acts and are not employees of GESA ASSISTANCE.

Furthermore, GESA ASSISTANCE shall not be held responsible for any failure to act on the part of those professionals and other organizations or persons.

However, GESA ASSISTANCE shall be responsible for fulfilling efficiently the obligations mentioned in the Agreement.

GESA ASSISTANCE will not be responsible for any expenses, fees or charges under the benefits mentioned herein which is on a need basis and directly by the client except for Towing and Emergency Roadside Repair which is reimbursed up to RM300.00 overall per claim.

1) Vehicles modified for racing, trials or rallying or participating in such activities.

2) Any claim arising where the Vehicles is carrying more passengers or towing a greater weight than for which it was designed as stated in the manufacturers specifications or arising directly from or out the unreasonable driving of the Vehicles on unsuitable terrain.

3) Loss or damage directly or indirectly occasioned by or happening or in consequence of war, invasion, act of god, act of foreign enemies, hostilities whether war be declared or not, civil war, rebellion, insurrection, terrorism, military and usurped, terrorism, military and usurped power, riot or civil commotion.

4) Any person who drives the Vehicle who does not hold a valid license issued by a competent authority.

5) Provision of services outside Malaysia and Singapore.
