Reproduced below is the paragraph of Yahoo's Terms of Service which I find objectionable:

8. CONTENT SUBMITTED TO YAHOO By submitting Content to any Yahoo property, you automatically grant, or warrant that the owner of such Content has expressly granted, Yahoo the royalty-free, perpetual, irrevocable, non-exclusive and fully sublicensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed. You acknowledge that Yahoo does not pre-screen Content, but that Yahoo and its designees shall have the right (but not the obligation) in their sole discretion to refuse, edit, move or remove any Content that is publicly available via the Service. Without limiting the foregoing, Yahoo and its designees shall have the right to remove any Content that violates the TOS or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by Yahoo or submitted to Yahoo, including without limitation information in Yahoo! Message Boards, Yahoo! Clubs, and in all other parts of the Service.

My main objection is to granting Yahoo the royalty-free copyright in the contents of my website, some of which, such as photographs, may be valuable. I would have little hesitation in allowing anybody to use them if they asked me, but I do not want to be signing my rights away like that.

I also don't agree with bearing all risks associated with the use of the content of my website by other people. This could be open to interpretation with all sorts of meanings.

Therefore I have not submitted any new content to this server since Geocities was taken over by Yahoo. The best way to find the current location of my website is to use the referring URL http://travel.to/nibussite/ .


Since I decided to move my website from Geocities, the condition about royalty-free copyright etc. has been watered down a bit. In the spirit of the terms of service now this part probably is not a big problem. The bearing all risks term remains however. There are also lots of other mildly unacceptable terms of service, which are changing unpredictably all the time. The next worst is one about removing a web site because of lack of use. The most recent version of the terms of service should be available here if you would like to see for yourself.
