The Young Offender's Act/The Paedophile

Let me start with: Canada... what a country!!! What a haven for crooks, paedophiles etc.

In my humble opinion, one of the greatest blunders ever made by man here in Canada happens to be the law on the young offender's act. Where a kid cannot be charged in adult court if he/she commits an offence under the age of eighteen. Even if he kills someone, the most he/she can get under the law is a maximum sentence of three years. They cannot be identified and the system protects them to the fullest. In the last few years there have been crimes commited by these young punks that would make Jack the Ripper look like a saint.

  • There was a case not too long ago where a bunch of wild little animals raped a twelve year old girl. One of the young offenders involved and apparently the leader of the gang was ten years old. He told the policeman that took him in that he knew his rights and that he could not be charged under the law.

  • A few years ago, in the province of Quebec an elderly man and his wife were brutally murdered by young offenders. The most these young punks got as punishment was three years.

  • A case just the other day where a young girl of twelve was raped and beaten by two young punks. One was nineteen the other was fifteen. The nineteen year old was identified and named in the newscast but because the other one was fifteen, the law protects him.

    The list goes on and on. I find it absurd. Many people in this country feel the same way. There have been numerous outcries directed at our politicians to change this silly law. Kids of today know what they're doing. The age of innocence is gone forever. I cannot believe that a fifteen year old kid doesn't know right from wrong!

    Our politicians seem to forget one major thing. They were elected to serve the people. They know what the people want, yet they refuse to address the issue. It's a mystery why they fail to act upon this issue. During the latest election campaign, not one of them had this issue on their platform.

    I think that we the people will have to start voicing our opinion on this disgusting issue. I think the laws must be changed to protect society from this blight. I think that parents must be made to be responsible for their children's actions. The punishment should certainly fit the crime. Unless that happens, I am affraid this society of ours will one day pay the consequences.

    I urge anyone that reads this item, to write or even email their members of parliament and voice their opinion. These people refer to themselves as "Honorable" and I would like them to earn that title by providing some action.

  • Just a bit of an update.... This past weekend, one of the schools in the west end of the city was vandalized .....over $200,000 in damages. After an excellent investigation, it was found that a couple of ten year olds had commited the offence. The net result? They cannot be prosecuted under the law! They know their rights! Meanwhile, the tax payers will be stuck with paying the bill. Including yours truly! What a system!....What an amazing piece of legislative crap! As a tax payer I resent that! I protest! Those little bastards sure knew what they were doing. I think the parents should be held responsible to the fullest! It's only right.

    PLEEEEEEASE....correct me if I'm wrong!!!!

    We have quite a disgusting character in this country by the name of Clifford Olsen. He was convicted 15 years ago to life, by virtue of having butchered eleven children. He raped them and killed them without compassion.
    At the time, our wonderful legal system paid this character $10,000 per body. The reason was that he would not divulge where he had buried his victims unless the governement paid him the set amount. The money went to his wife that had the good fortune of being married to him at the time.
    In our legal system, here in this wonderful country of ours, there is a clause which states that a killer may apply for early parole after having served the minimum of fifteen years behing bars.. Well..let me tell you...Our wonderful man which should have been executed years ago, applied for this early parole. Not only that...but... our wonderful judicial system, granted him the review...because this animal had rights!

    He had more rights than the poor victims that cannot speak for themselves... He had more rights than the relatives of these poor children that will have to endure this circus once again. The wonderful governement that we have here in Canada alloted two full weeks to review the case...and to see if this animal can be set free again. Meanwhile, all along he has been saying that he killed as many as 60 people in Canada as well as in the states. That, doesn't matter! He has rights!

    He knows full well that he will not walk away. He knew that when he applied for this crazy nonsense. Regardless, the government went along with it. After all it's only tax dollars! They escorted this piece of low life out of his cell from the great Ontario to his review board in the west end of Canada. A trip that I, as an honest man cannot afford. He was under escort and protection, like a royal parasite! The relatives of the victims had to pay their way. The case is still under review, costing thousands of tax dollars because this asshole has rights!(please pardon the expression)

    I am angry! I am absolutely devastated! How can this be?
    This low life piece of trash has more rights than any of us!! I know...I have been touched by our judicial system! When my daughter who was fifteen years old at the time was sexually molested by an animal, a so called man, with a record longer than my arm, the law took it's time. When the case finally got in court, a wonderful old senile judge, dismissed the case, because it took four years to get there. I was livid! Need I say more? Here now, we have a system that protects the rights of criminals and lets the honest people deal with their own devils. Is it right?

    I feel that any man that has been found guilty of multiple murder should be executed! Especially if it involves children! Just imagine the terror these kids endured at that fatal moment...
    Why don't we change these laws? Why can't we change them? After all are we not the people?

    There is no politician in this world that will get my vote unless this issue is on their campaign platform! I urge you all out there to do the same! Ask the questions before you elect!

    We are the people, not sheep! Stand up and be counted! The next victim could be your child!



    Roman Polanski...a film director...Once married to Sharon Tate...who in turn was killed by Charles Manson...20 years ago, he drugged and raped a thirteen year old girl. Before sentence could be passed, he escaped to France..where he shacked up with a fifteen year old girl. Clearly he is without a doubt a paedophile. A low form of life. Well..the wonderful US Governemnt which in my opinion is just as bad as the Canadian one...will allow him to come back in the US and direct films there. All may be forgiven. This animal has not served a single day in jail for what he did twenty years ago. Only God Knows what he did in between. Well...after all he wants to direct an epic movie there in the States...all sins forgiven.He's got the bucks!

    Let me ask you something, as a parent that had a daughter deflowered by an individual like that, how would you feel? Would twenty years erase the pain and torture that you have endured? I THINK NOT!

    I speak from experience...and to this day the pain and anger are still there.
    Get off you butt...make yourself heard!!!! I urge you to ask your next aspiring politician that knocks on your door what is he going to do about this...
    It's the only way that we the people can be heard!

    TAXPAYERS TO PICK UP TAB FOR BERNARDO LAWYER

    Ontario's highest court yesterday ordered the government to pay for a lawyer to represent Paul Bernardo at his appeal and gave the sex killer six weeks to submit a list of candidates. "They've ordered he have a level playing field," said lawyer Tony Bryant, who argued the motion. "I'm obviously very pleased on behalf of Mr. Bernardo that he will have a fair opportunity to present his case on appeal" and not appear alone.
    Bryant said he couldn't speculate how much it will cost the Attorney General to pay for Bernardo's appeal lawyer. A brief submitted earlier to legal aid suggested $50,000. "No one can ignore the enormity and horror of these crimes and the incalculable harm they have done to many innocent victims," said the panel. They added that even though Bernardo is seen with "revulsion" he must have an appeal "provided by the law of the land."
    The court said it is the most horrific cases that test the dispassionate fairness of the criminal justice system and "it must meet that challenge." Bryant, one of Bernardo's trial lawyers, "for sure" will not be appearing before the appeal panel. He said he doesn't argue appeals on trials he worked on because it's best for someone to take a "fresh look."
    Bernardo has been given until Feb. 1 to provide the court with the name or list of names of counsel he would like. The court noted the lawyer must be someone "willing to take the brief." The panel ruled the government must pay for the new lawyer either through the A-G's office or legal aid. The motion was spurred after the legal aid plan rejected Bernardo's request to pay for a lawyer at his appeal.
    Bernardo is appealing his conviction in the killings of schoolgirls Kristen French and Leslie Mahaffy. He claims his accomplice Karla Homolka is the slayer. Bernardo is serving a life sentence. The court also ordered the Attorney General to pay for Bryant's fees in connection with hearing the motion. Bryant said he has yet to calculate a fee. Although Bernardo is a "reasonably intelligent and articulate person," he has no legal training, the judgment stated. Bernardo also has limited access to facilities because the prison must be locked down whenever he leaves his cell.
    The appeal hinges on a unexamined discrepancy between Homolka's testimony and a pathologist's about whether the victims were comatose at death. The judges said it was argued that since Bernardo is a dangerous offender his appeal is futile, but they noted there's "nothing put before the court to support the contention that the appeal would have no practical consequences for the appellant."


    Here is a perfect case of the crazy judicial system in Canada. Where an animal has all the rights in the world and the victim has none! Clearly Paul Bernardo should have been executed long ago together with his wife Homolka. Instead she will come out of the pen with a university degree...and he may just get a new trial.

    The last investigation has cost the Canadian tax payer over 25 million dollars to investigate and convict the couple from hell!

    It's an injustice! It's a joke!

    The pedophile in Durham's midst

    An untreated pedophile released last week from Warkworth prison is spending his first days of freedom in Durham Region, likely in Oshawa, The Toronto Sun has learned.

    Yet Durham Regional Police wouldn't provide that same information to residents, refusing to release his photo or issue a warning to parents about Gregory Austin.
    In fact, Det. Tom Hart, of Durham's parole monitoring program, wouldn't even confirm OPP information that Austin was living in Durham. "My personal position is we can't confirm if he's here or in Toronto or anywhere in Ontario," Hart said yesterday.

    As we reported Sunday, Austin, 32, was released last week after completing a six-year sentence for seven counts of sexual assault.
    His victims were seven little girls in Minden, aged four to 10; his vicious assaults stretched over six years and included oral sex, anal and vaginal intercourse under threats of violence. He used one little girl to lure her friends and then would photograph and video them as well as attack them.

    Now free after serving his entire sentence, Austin is believed to be living in an Oshawa apartment. Late yesterday, after numerous Sun phone calls, a Durham spokesman said Austin was no longer in the region. "As far as we're concerned, he's still down there for now," said Det. Sgt. Kelly Anderson of the OPP's Minden detachment, which must be notified 24 hours in advance of any change in Austin's whereabouts. "We haven't received any notification that he's moved."

    Austin is an unrepentant pedophile who was refused early release three times by the National Parole Board on the grounds that, untreated, he was likely to commit another sexual assault on a child.
    Throughout his six-year sentence, the board noted, Austin refused all treatment offered. A psychologist's report found no sign of remorse or insight into the harm he'd caused, noting that Austin even boasted that his assaults made sex "fun for kids."

    That history -- and pressure from their fearful residents -- was enough to persuade the OPP in Minden to seek protection for the community under the controversial Section 810.1 of the Criminal Code -- which places a released offender under parole-like conditions even though he's served his complete sentence if someone "fears on reasonable grounds" that he will commit a sexual offence against children.

    Through their laudable efforts, Austin now must not establish contact with anyone under 14 and must inform police of his whereabouts during the 12-month peace bond.

    "We can't say a person like Mr. Austin will offend again for certain," warned the OPP's Anderson. "(But) the danger posed by this man caused us enough concern to go to the lengths we did to prepare the Section 810.1 application."

    It is then up to the local police in his new community to decide whether they want to publicly warn its residents. Passed last October, Bill 102 allows the chief of police to release personal information -- including the convicted pedophile's photo -- in the interests of community safety.

    So far, Durham Regional Police have decided not to do so.

    Incredibly, Hart says that what is often at issue in deciding to go public in high risk offender cases is whether such a warning would be "counterproductive to his re-integration into society." Never mind the rights of the area's children.

    "What about the safety of the next child?" demands an incredulous Jane Cooper, who knows one of Austin's Minden victims. "He gave up his rights the first time he laid a hand on a child.
    Yesterday, we were warning parents about dangerous playpens. What about protecting children from a dangerous offender?"

    True, police are likely monitoring his movements, she acknowledged, "but they can't babysit him 24 hours a day. People need the information, not for vigilantism but to protect their kids."

    Me, I've been accused of being a bleeding heart at times and I could probably be convinced this guy deserves his privacy if there were clear, strong evidence that he was indeed remorseful and that treatment had made him a changed man.
    But all the reports from the parole board indicate that this high-risk pedophile has made absolutely no effort to understand or reform his dangerous behaviour.

    It's also small comfort to know that Austin is prohibited from being near children under 14. When he was awaiting trial, he was also not allowed to be alone with young children. Yet, his parole review noted, "within days you had intercourse and oral sex with (one)."

    Parents have a right to be warned. Their children have a right to know whom they must avoid. Instead, their own police force has left them all in the dark.


    This is but another shinning example of the laws that we deal with in this country. The above story makes me puke. How can we the people just let our elected politicians know that we,e had enough?

    I suggest you remind these imbecilles that voting time is just around the corner. Let's change this nonsense once and for all! Let us demand justice.


    On a personal note, my daughter was fifteen years old when she was sexually molested by my ex wife's boyfriend. He had passed himself up as a doctor. In the three short months that he lived at the house with my then first wife, he managed to ruin my daugter and her girl friend.
    The case managed to go to court but it took four years to get there. When it got there it was dismissed on the grounds that it took too long to get there.

    I was livid! I was almost arrested for contempt of court for having called the judge an asshole.

    My daughter is now twenty four years old and is still troubled by the ordeal. I can only imagine what a younger child would experience.

    It sickens me!

    Five teens charged with first-degree murder

    MONTREAL (CP) -- Five boys -- one as young as 13 -- were charged Wednesday with first-degree murder in the multiple stabbing of an 81-year-old woman.

    The 13-year-old pleaded not guilty and will be tried in youth court under the Young Offenders Act.

    The other four youths -- three are 15 and the other is 14 -- entered no plea. Crown prosecutor Jacques Diamant said there had been no decision on whether to try the four as adults in Quebec Superior Court.

    One of the 15-year-olds is to undergo a psychiatric evaluation and return to court for a pro forma hearing Oct. 22.

    The other 15-year-olds and the 14-year-old will return to court next Monday.

    All five youths were remanded in custody after they appeared in court in suburban Longueuil.
    In addition to first-degree murder, the teens are charged with armed robbery, conspiracy and being accomplices after the fact. One is charged with possessing an offensive weapon.

    The victim, Pearl Rushford Lamarre, who lived with her son and daughter-in-law, was savagely attacked with a sharp object "many, many times," said Quebec provincial police Const. Manon Gaignard. Gaignard said Lamarre's wounds indicated she fought desperately to defend herself. Lamarre's home in Chambly, a suburb east of Montreal, was robbed but Gaignard would not say what was stolen.
    "The investigators found no sign of forced entry, which may mean the woman knew her attackers," Gaignard said.

    Lamarre's son-in-law found the victim in her kitchen when he came home from work at 3:15 p.m. Monday.
    Leonard Nadeau, a friend and next-door neighbour of Lamarre for 45 years, shook his head and said, "It's easy to attack old people. They can't defend themselves. What do you expect?" For many Montrealers, the case sparked painful memories of a 1995 murder that took the lives of Frank Toope, 75, and his wife Jocelyn, 70, bludgeoned to death by juveniles with baseball bats.

    Some drew comparisons with the senseless slayings last April in Littleton, Colo., when two gun-wielding Columbine High school students killed 13 people and took their own lives.

    Pierre Poupart, a Montreal youth centre co-ordinator, said it's inevitable that people will point to the Columbine High School deaths when trying to analyse the motives behind youth crime. "There could be a comparison," said Poupart, who called such events "the tip of the iceberg" of society's violence. "It's very shocking when crimes are committed by people who are so young.

    "There are all sorts of hypotheses. Is there one person in the group who's mentally ill and drew the others into the affair? Were drugs involved? What happened, exactly?" he said. "We don't know yet."
    However, Poupart urged parents to persist in overcoming any communication barriers with their teenage offspring, and to speak openly about their own feelings in the face of horrendous crimes. "It's important to tell them our reactions," he said. "Tell them how you feel. Even if you feel like giving up, don't do it."

    Teens' charges reduced

    Family of beating victim livid

    The family of Jonathan Wamback is furious that charges against three teens accused of attacking their boy have been reduced from attempted murder to aggravated assault.
    "It sends a clear message to all young offenders that they can almost kill someone and get a light sentence," said Jonathan's mom, Lozanne.

    The maximum sentence for aggravated assault is two years in jail, but it could also be in open custody or alternative sentencing.
    The decision in Newmarket court yesterday to pursue aggravated assault charges also essentially ends all hope of moving the case to adult court.
    "We're outraged; we're frustrated," said Joe Wamback, who was in court yesterday. "We're down, but not out."

    On June 29, Jonathan was attacked by three teens blocks from his Newmarket home. The 15-year-old's skull was shattered and he suffered brain damage in the beating that left him in a coma for three months.
    The Wambacks knew the reduction in charges was a possibility. They'd been advised that proving attempted murder is difficult. Still, the decision stung the family.
    "Jonathan can still only dream of walking by himself and the cowards who attacked him walk out of the courtroom with smiles on their faces," Joe Wamback said. "Jonathan goes to bed every night in pain."

    He said he'll be going to Ottawa on Feb. 23 to push for tougher legislation on young offenders. "This decision only adds fuel to the fires of passion we're trying to ignite across the country for changes," he said.

    How much more of this nonsense will we swallow before anything is done? How can a senile old judge make a decision like that? This is ridiculous to say the least. Let's stand up and be counted! Please do write your MP and let him know how you feel. A lot of water has gone under that proverbial bridge. So many other incidents have occured in the meanwhile. Twelve and fifteen year old little cocksuckers doing things that you and I would be locked up for life. Paedophiles molesting young children as young as a few months old. Bastards that are released from Jail into a comunity full of children. They have their rights because they have served time. I ask anyone out there with kids... How do you feel? How do you think that your child would feel if he or she was to be deflowered by a piece of shit with all his rights?

    The law needs to be changed. We are the public for which these laws were dreamed up and written down. How come we can't change them? I say let's bring out the death penalty back for anyone that hurts our children. I say let's treat these young offenders like adults and throw the fucking book at them once and for all. I say let's reserve our votes for the politicians that will change these miserable laws to work for our protection and the protection for the ones that can speak for themselves.

    I ask to do something worthwile for your children and grand children. They happen to be our most prized treasure. I ask to speak to your man that comes knocking on your door when election time is there.

    I ask for something fucking wonderful to happen! Tell the politicians to screw themselves unless they have an agenda pertaining to the young offenders and the ones that take advantage of our children.

    Never mind voting themselves raises and golden pensions. They should all get that big fat fist out ouf their asses and start working for us, the people.

    Jean le Cretin had his chance. He even managed to make Brian Mulrooney look bloody good. Now we wait and see what the next asshole will do! If he wants my vote I want to know what his agenda will be. I hope you all feel the way I do. You obviously do if you,ve come this far without being offended by my vulgar language. It was the only way that I could drive the point home.

    My language is very offensive I know. Yet,it's the only way that I can drive the point home. That is much more than a miserable politician or a stupid judge will acknowledge. After all, they have guidelines which may take a generation or two to change. In the meanwhile our children get messed up and paedophiles go free with their family jewels intact. In finishing, I have only one question! How come the politicians that we elect can vote themselves a raise without missing a stroke, and we the people have to wait so looooong for some action?

    It's been a while since I put my two cents in. A lot has changed in the world, but not realy. Paedophiles still roam the streets and the young offenders still commit crimes without punishments.
    My other issue is the terrorists that kill innocent people because of their crazy mixed ideas. They think that the great Hallah will protect them. So what do they do? They blow themselves up with innocent children and people that don't even know what politics are. How come none of the leaders give them the example to die for a cause, such as the mighty Osama the Crazy?
    I say that when caught they should be shot without pity. After all they were going to die anyway. Not only that, but their whole immediate family should be killed as well. Starting from the eldest to the youngest, without pity.
    These people deserve no mercy in my book!!! They are criminals. They have no mercy with our innocent children and women. It's about time that the western governments make examples of them.
    If this is a hate site, then so be it, but I know that we the people are fed up with this crap. Our children deserve to live in an environment without hate. Our women deserve to be treated like human beings instead of slaves.
    Let me just say that I hate this crap.
