DOG PURCHASING CONTRACT

2. SELLER'S REPRESENTATIONS

The following representations and conditions apply to the sale of the aforementioned dog:

______ ______ a) As of the date of this agreement, the dog is in good health and free of communicable diseases.

______ ______ b) The Buyer has 72 hours to have dog examined by a veterinarian and to personally inspect the dog. Any claims must be made within this time period and will be verified by Seller's own veterinarian. Proof of inspection will be required prior to Seller forwarding AKC papers to Buyer.

______ ______ c) Buyer may return puppy to Seller for a full refund for any reason with in 48 hours of purchase, providing Buyer agrees to pay all transportation costs to Panchito Chihuahuas Kennels.

______ ______ d) Buyer is completely satisfied with and waives any and all claims regarding the dog's conformation, and outward appearance (meaning the dog meets the breed standard at this age).

______ ______ e) Buyer agrees upon purchase of the puppy that the Dog will be registered with the Kennel name: Panchito's followed by a name of Seller's determination.

3. CONSIDERATION (circle either a or b)

______ ______ b) This dog, identified in Section 1, is being sold for the sum of $_____________. $_____________ paid on ______________as a non-refundable deposit, the remainder to be paid in full by_______________. Dog or bitch will be shipped to Buyer when paid in full at Buyer's expense. All other arrangements must be made in advance and in writing signed by both Buyer and Seller.

4. STIPULATIONS

This dog or bitch has been graded to be PET / SHOW quality (circle appropriate grading).

______ ______ a) If PET quality, Buyer agrees that seller will register said dog or bitch on an AKC Limited Registration. Seller will hold this non-breeding registration until veterinarian verification of spay or neuter is received.

______ ______ b) If sold as SHOW quality and dog/bitch is diagnosed with crippling luxating patella, either by Seller's and Buyer's veterinarian or by the Orthopedic Foundation for Animals (OFA), Buyer can either agree to keep dog/bitch providing dog/bitch is spayed or neutered or may return to Seller. If returned Seller agrees to replace said dog/bitch with another of same sex and grade for 50% of purchase price.

______ ______ c) Any other arrangements may only be made with Seller's written consent.

______ ______ d) If buyer chooses to sell dog/bitch or otherwise place him elsewhere, Seller gets first chance to re-acquire dog/bitch according to terms agreed to by buyer and seller at that time.

5. LIMITATIONS OF CONTRACT

______ ______ a) This contract applies to the original puppy only and is nontransferable to a second party. No replacement puppy will be given if the male or female has been bred, neutered or spayed. Buyer is responsible for transportation costs to and from ______________________Kennels on original and replacement puppy.

6. MAINTENANCE

______ ______ a) Buyer agrees to maintain this dog in good health, provide routine preventative health care including, but not limited to , inoculation, internal and external parasites, and - where indicated - heartworm preventative medication.

______ ______ b) Buyer further agrees to provide proper exercise as indicated in order to maintain this dog or bitch in proper weight and physical shape. A proper diet consists of top-quality dog food and supplements. Foods NOT to be fed include highly commercialized brands with artificial preservatives. Vitamin E is an acceptable preservative.

______ ______ d) Buyer agrees that this dog or bitch is NOT to be LEFT IN A BACKYARD OR KENNEL ONLY. This dog or bitch is sold with the understanding that it was to go to carefully selected parties and that Buyer AVOWED the dog or bitch would become a member of the family. (This is to assure proper development and maintenance of the temperament for which the animal was bred.)

______ ______ e) Breeding Prerequisites: Breeding of a bitch shall be every other heat cycle or no more than 1 (one) back to back cycle with a 1(one) year rest period before again breeding and ONLY after the age of 2 (two) years.
A stud dog will NOT breed any more than 2 (two) bitches in any one week.

______ ______ f) Buyer agrees to provide Seller with Photographs suitable for advertising and photocopies of all awards and critiques along with the judge(s) name(s) and the Club sponsoring the show. Buyer also agrees that Seller may use the photographs and any particulars of qualifying awards in any future advertising.

______ ______ g) Buyer agrees Seller will REPOSSESS DOG OR BITCH UPON EVIDENCE OF NEGLECT AND/OR ABUSE at no expense to the seller.
